Xi Jinping's Research On The Construction Of The Rule Of Law Government

As China has proposed to establish a law-based government in 1990s, a deadline for the project was set in the 18th National Congress of the Communist Party of China. Besides that, the idea that we will prompt the progress was punctuated in the Third Plenary Session and the Fourth Plenary Session of the 18th Central Committee of the CPC. The preceding government construction thought, presented by president Xi Jinping, as the essence of governing philosophies of the CPC new leadership team, makes great directive significance for law-ruled government construction. This paper conducts the research from three aspects:In the first part, we analyze the historical background and theory sources of the formation of Xi's law-based governing construction thought. This thought was set up to meet the necessities for enhancing the governance capacity, adapting to domestic development and advancing the internationalization and globalization of China. In the process to initiate the thought, Xi makes use of empirical experience of other countries, meanwhile, he incorporates "the doctrine of the mean" tendency of Han Fei's thought into his theory.In the second part, we research the main content of Xi's construction thought. The foundation of law-ruled government construction consists in the lawful control for the source as well as the employment of government power. Furthermore, constraining government power, publicizing the government affairs and fully combating corruption in China are security of construction. Examining qualifications of law enforcers, completing enforcement procedure and improve the capability of law enforcement are the approaches to achieve the construction, validly implementing the execution of the project.In the third part, we define the guiding significance of Xi's government construction thought. We must strengthen the organization of law enforcement and security system, step up the surveillance and limitation of power and build a high-quality team for law enforcement so as to make it possible and compulsory for administrative staff to initiatively serve the government and people.
