Research On Legal Interventions For Youth School Violence

Youth school violence has become a concern and but social problem.Nearly two years past,there are dozens of vicious youth school violence in our weibo community,moments,and on the television network media.The behavior of the events which appear in front of our eyes is the tip of the iceberg of school violence.Youth increasingly severe and frequent school violence is escalating instead of containment by corresponding legal measures of intervention.The existing youth school violence presents a number of prominent features include means of concealment,diversity and bad,mass and complicated.It also showed a trend of certain: younger age,women's rising subject,scope creep etc.and its properties and social influence are also very bad.To prevent youth school violence,the author researched and analyzed the existing problems of legal intervention found that the law legislative intervention measures of youth school violence are scattered in multiple sectors and different scopes.Not only its relevant legal is general,but also the interoperabilityis not strong.And part of the regulatory penalties is on the low side.At the same time,regulatory responsibilities are not clear to form comprehensive governance.So we need to strengthen the legal intervention of youth school violence.First,we therefore need to formulate relevant legal specifically and systematically.We start from carrying outlegislation survey drafting of youth school violence.Then we study on special school violence for youth with psychological experts,education experts and law experts.Finally we absorb local experience to put some effective practice to rise to the law.Also combined with some of the theoretical research and practical experience at home and abroad we make our legislative guidancespecifically and systematically.Second,we must specific content of the legal and implement legal operational problems.We'll be the first to eliminate ambiguity in the existing law terms and to remove the general provisions of the provisions.Then we will increase the specification detailed provisions.In view of the existing characteristics and trend of youth school violence we'll perfect relevant legislation blank and implement the supervision of law enforcement at the same time.Third,it should increase the corresponding penalties.On the one hand we need to increase the legal penalties on the basis of the existing law,on the other hand to increase the kind and content of the punishment measure.We also need to grasp the degrees of penalties scientifically and rationally to be tolerant but not indulgence which can have good education for adolescents and let them accept responsibilities after breaking the law.The forth is to clear the responsibilities of the relevant.Factors such as family,school,society is the main factor that lead to the youth school violence.It is helpful to fulfill the duty respective to clear the school responsibility,social responsibility and family responsibility.In addition it also requires the legal supervision to guarantee the main body to carry out the law responsibility.Aiming at the problems existing in the comprehensive treatment,the school,social and family need to strengthen communication and cooperation.Among the different subjects they need to find in time,help each other,and joint prevention and control as well.Finally we consider to set up the related comprehensive department which can contact each other.The function of law is not everything.It need other resources to cooperate,to make the implementation of the law more efficient sothat we can realize the role of law should be and should play a role of guarantee.
