Comments On The Legal Regulations Of School Violence In Middle And Primary School In China

In recent years,Campus violence is frequent,It has caused social concern about campus safety,The government and education departments successively issued a series of management policies and regulations,Premier Li ke qiang has also made important comments on campus violence,This opens up the management of campus security problems,However,the existing measures are still the requirements and regulations of relevant authorities at the policy and system level,There are still some questions about timeliness,stability and standardization,The author thinks that the campus violence of primary and secondary school students is already on the boundary of law,It must be regulated at the legal level,Only in this way can campus security be effectively guaranteed.This article aims at the present stage our country middle school campus violence violence between problem analysis on the legal level,to the primary and middle school campus violence between middle school students of a series of problems in the prevention of juvenile delinquency,regulating,ultimately achieve perfect legal system of prevention and punishment of minor crime in China.This paper is divided into four parts:The first part is the introduction,which mainly includes the background,literature review and research methods.That is,why school violence should be taken as the main research subject,the current research status of this problem in domestic and foreign academic circles and the main research methods adopted in this paper.The second part is about the current situation of campus violence in China's primary and secondary schools and the existing problems and causes in the legal regulations.First,the concept of school violence in primary and secondary schools is defined.Secondly,the development status and problems of campus violence in recent years are summarized according to relevant cases of school violence.Thirdly,it summarizes and analyzes the current legal regulations on campus violence in China,sorts out the existing problems and explores the causes of campus violence in various aspects.The third part discusses the overseas legal regulation on campus violence and its reference to China.First,the comprehensive analysis of foreign experience in preventing campus violence;Secondly,it summarizes the experience of our country's existing regulations,and explains the inevitability of campus violence legislation.The fourth part puts forward some Suggestions to improve the legal regulation of campus violence in China.Based on China's national conditions and existing laws and regulations,combined with the advanced management experience in foreign countries,this paper discusses the concrete idea of regulating campus violence in the law on the prevention of juvenile delinquency.The specific content includes five parts,including the definition of the basic meaning and content of campus violence,the investigation and implementation procedures after the occurrence of the incident,the division of education departments,schools,parents,and the rights and obligations of all responsible subjects,strict and reasonable auxiliary and disciplinary measures,and the spiritual protection measures of victims.
