Research On The Infringement Of Writing Right Of Wechat Public Number

In June 2014,The First People's Court of Zhongshan city in Guangdong Province publicly heard of the first copyright infringing case about Wechat Official Accounts.However,before this,since ‘WeChat Official Accounts' was plated on-line,such disputes have been emerge in endlessly;and the reason of their not getting into action is only because the objects are too little.With the rapid growth in the number of the Wechat Official Accounts,the number of various disputes also increases.Among these,copyright infringing disputes' prevailing on WeChat Official Accounts have catched the most eyes,which grants practical significance for this project.This essay,through the analysis of Wechat Official Accounts' features and with the study on real cases,can specificly be divided into the following three parts:The first part is about the problem's proposal.In this part,it will mainly be explainedthat what are the definition,category,features of Wechat Official Accounts and what the three modes of geting profits through Wechat Official Accounts are.What will also be analyzed is how to get profit through infrindgements about Wechat Official Accounts;and lies of Wechat Official Accounts are non-profitable will be scotched.The second part is about the analysis of the problem.Started from the four elements recognized about infrindgements of copyright on Wechat Official Accounts,under what conditions articles on Wechat Official Accounts should be alleged to be infrindgements of copyright will be discussed.Then from perspectives of safe harbour rules,red flag principle and reasonable use,copyright infringement liabilities of Wechat Official Accountswill be analyzed.The third part is about the solution of the problem.From theree aspects of legislative proposals,WeChat operator approach and self relief,the authuragrees with various measures of WeChat operator,and analyzesthe strengths and weaknesses of three ways: bargainning by the victim himself,commissioning a third party and conducting prosecution.By literature research and empirical analysis,this paper analyzes the We Chat Official Accounts' profit model,with which the nature of non-profitable of Wechat Official Accounts can be proved.Then,from three aspects of WeChat operators,We Chat Official Accounts' operators and fans,this paper analyzes specific responsibilities they should burden,which can be referred to for articles' original authurs' behaviours of protecting rights.After comprehensive considerations,turning to a third party organization is the best way of rights.For an instance,Rightknights has been successful in helping many original author rights,and has achieved good effect.The writer hope this paper can prevent original authors from numerous infrindgementin Wechat Official Accounts.Everybody is the original author and all of them enjoy the right to profit from it.
