On The Appropriate Adult Participation System

In recent years, the number of minor crime in our country has been decreased. But there appear trends of minors younger, crime means diversification related minor crime, which still is the problem needs to be solved in our country. When the crime minors enter into the criminal procedure, the judicial organs should focus on and safeguard their litigation rights. In the litigation activities of the acceptance of investigation and interrogation by public security organs and the courtroom trial investigation involving crime minors, the appearance of an appropriate adult as a third party can effectively guarantee the physical and mental health of minors and litigation rights not be violated, and can also play a role in educating to reduce the possibility of the crime again.This article consists of four chapters, which makes studies about the system of appropriate adult participation from theoretical analysis, outside investigation, the present situation and existing problems, the consummation suggestions. The first chapter of the theoretical analysis is to create a clear understanding of the system for reader. The second chapter of outside investigation makes research about the two selected representative countries from the Continental law system and the Anglo-American law system, from which we draws lessons of the advanced experience. In the third chapter, after analyzing the current situation of the system of the appropriate adult participation in our country, many problems both in legislation and judicial practice are found existed. For example, there is only one legal provision to support and the different appropriate conditions of adult candidates in the practice about the system of appropriate adult participation in our country. In the fourth chapter, some suggestions are put forward from legislation, selection, working mechanism of the appropriate adult participation.The system of appropriate adult participation in our country has begun to take shape.Pilot work has been carried out in small areas across the country. But the legislation system is still quite imperfect, and application in practice is also chaos. Therefore, the in-depth theoretical study about the system of appropriate adult participation is very necessary.
