Research On Fraudulent Behavior Of Fraudulent Use Of Credit Cards

Petty trade in recent years,with the increasing and the diversity of transaction,the credit card that has the financial instruments,multiple functions such as cash in advance,more and more by the general public use and rely on.But it should be noted that along with the widely used of the credit card by the use of credit CARDS and all kinds of social problems which caused by the mismanagement is also increasing.In common "use the other legacy in automatic teller machines(ATM)have input the correct password within the credit card transaction behavior",for example,not only what the debate by the public and financial institutions who is going to take a loss,the judiciary also on the behavior of qualitative,however,encroach on theory,theory of theft,credit card fraud,three kinds of theory of parallel and have their own arguments.To this,the author agrees with the behavior of credit card fraud.Through the typical case analysis,combined with the author of "credit card and the card within the capital ownership" problem as well as to the automatic teller machine(ATM)can personal understanding of the doctrine of "cheated",eliminate the behavior as misappropriation or theft.On this basis,through the analysis of credit card fraud crime constitution,the use of "legacy" behavior as "theft" of this kind of criminal behavior,the author then come to the conclusion that the behavior belongs to credit card fraud.In addition,the author suggested to perfect credit card crime legislative,judicial,can add to use a computer fraud or by the relevant judicial interpretation "projects".
