Empirical Research On Extradition Systems

The term of extradition is much earlier than the formation of the system,and the formation of the extradition system is used to realize the Extradition between the state and the state.And extradition system time can be traced back to 1280 BC,ancient Egypt and the Hittites in the signing of the Treaty of peace,Columbia to the United States extradition drug Montoya made a return of fugitives provisions.In Fourteenth Century,the first treaty on Extradition was officially emerged.The treaty was defined by the different faiths and political prisoners.In the middle of nineteenth Century,the extradition system was born in many countries.Inter American and extradition treaty between the United States and Romania,the United States and the Romania extradition treaty between the United States and the United States,Britain and Sweden extradition treaty between the United States and,such as the United States and between the United States and Sweden.The succession of these treaties,on the one hand,the provisions of the extradition object,on the other hand,also made the provisions of the extradition method.The Extradition Law of our country was promulgated and implemented from December 28,2000,the full name is "the Extradition Law of the People's Republic of China"(hereinafter referred to as "Extradition Law").The law includes four parts,respectively is general,foreign to our request for extradition,our country to foreign for extradition,the main legal supplement and implementation date.Since the implementation of the Extradition Law in China,many experts and scholars have been concerned,and have carried out in-depth research.This paper is based on current our country the Extradition Law Status to carry out research,especially in recent years,the most complex Huang Haiyong extradition case as a typical case to study,analysis of the current China's extradition system existing problem,and to solve the problem put forward China's extradition system improvement suggestions and countermeasures,for future extradition system development and to provide the reference.
