Research On The Labor Reform Function Of H Prison In Yunnan Province

Criminals labor reformation has played an important role for a long time in the process of social and historical development.After the founding of PRC,labor reformation was established as a elemental form of criminals reformation.In 1994,the Prison Law of PRC established labor reformation's position in terms of legislation.In practice,through labor reforming,a large number of prisoners have been transformed successfully,a huge amount of economic benefits have been created and the prison industry has improved a lot.But with the political,social and economic situation in China changed rapidly,a long term fixed prison management system can't meet the development and changes of prisons.Criminals labor reformation has also produced many problems in legislation and practice,thus impacting the quality of the criminals reformation and directly influence its own fuction of reforming criminals through labor.Since 2008,the prison reformation had taken place all over the country,and the labor reformation would experience a new challenge together with the implementation of the prison system reformation.Under this environment,how to set the position of the labor reformation,how to allocate the resource of prison to organize criminals labor reformation,how to make labor become a effective form to reform criminals,these questions are worth thoroughly pondering.This article is composed by five chapter,mainly discussing issues in terms to labor reformation in prison.The first chapter studies the basic theory of criminals labor reformation,describe the basic concepts,features,nature,status,efficiency and regularity of the criminals labor reformation and then introduce the seven functions of the criminals labor reformation,providing a theoretical ground for the research on relating issues.Chapter Two offers us an example of current situation of the criminals labor reformation of Prison H,starting from the study of the organizational structure and current situation of Prison H with the combination of text and graphics.Chapter Three deeply analyze the seven big problems on the basis of the preamble and then gradually discuss the reason why.The fourth chapter introduces the example of prison labor reformation abroad,and this can be recognized as a generally legal norm,furnishing an extensional reference to solve the problems mentioned above.The last chapter,the fifth chapter,discusses the methods to solve the problem of Prison H and puts forward measures and suggestions on the basis of analyzing its own problems and absorbing foreign experience and providing reference for Prison H to solve these problems and make its function of criminals labor reformation to maximum capacity.
