The traditional legal system of china is "All kinds of law as a whole,regardless of the civil law and the criminal law",the administrative and the judicial are unity,despise the procedure,judicial has no independence,and become subservient to the monarchy.After the opiun war,The problems the qing government face at home and abroad exacerbated,the qing court building is to collapse,the traditional natural economy gradually disintegrated,calls for taking back of extraterritoriality is rising,new economic factors and social thoughts are creating.The influence of Sue report,the promise of of the western powers to give up consular jurisdiction,the influence of the russo-japanese warr,led to the reform of the judicial system in the late qing dynasty.From 1901 to 1901,the qing government took ten years to take constitutionalism reform,set up the dali court as a relatively independent judiciary,introduced of the advanced western lawsuit system,while the reform failed,but the reform is to promote the traditional economic structure gradually disintegrated,the new social ideological trend rise ceaselessly,promote the transformation of the judicial system reform in the late qing dynasty,this reform is of great positive significance,and has the storical limitations of the era entrusted.To explore the background of the reform and its significance in the late qing dynasty,has reference significance to today's reform of the judicial system.
