Research On PPP Mode Under The Scope Of Administrative Law

Under the background of global urbanization,China has successively entered the high-speed development of urbanization.The PPP model in infrastructure construction and complete administrative tasks,arouse folk force,the unique experience of social capital technology and management system into the PPP project cooperation.After decades of exploration,but the understanding of the PPP model in our country is still in its infancy,in the process of the traditional administrative management,the government after is ease the financial pressure,in short,understanding of the PPP only stay in the past government financing level,as a source of funds to provide public service or product.Along with the advance of economic,social,legal,and social development needs the transition of the function of the government,under the background of the national policy of multiple files for cooperation to provide legal aspects of the social capital and government support.But although every department after a specification file,but these files are all administrative rules,legal level is low,exist the problem of overlapping each other,experts and scholars of the research is confined to theoretical groping stage.The author combined with relevant materials to the PPP and expounds the meaning of the new administrative law,the bonding performance of PPP are summarized and the new administrative law,and then expounds the common theoretical background,the PPP and the new administrative law through the present situation of the PPP in our country legal regulation,and then points out that the PPP model in the defects in the legislation,procedures and controls;Post part,through the foreign and the PPP in our country administrative law regulation pointed out that the PPP mode compared to administrative law regulation and puts forward the necessity of the solution and suggestion to improve the legal status,to perfect the PPP contract law,perfect the procedure of government departments and social capital,set up effective and independent regulators.
