Analysis Of The Scope Of Application Of Criminal Reconciliation In China

The criminal reconciliation system originated from the victim offender mediation procedure in Canada,and then it was popularized in Western countries.Our modern criminal reconciliation system of a late start,until the last century in 90 s based on the criminal reconciliation system,absorbing foreign successful practice on China's theoretical circle and practice circle began to research on the system of criminal reconciliation.Criminal reconciliation is not only the product of the combination of Chinese and Western culture,but also the inheritance and development of Chinese legal culture in modern society.The revised criminal procedure law of the people's Republic of China in 2012 formally established and regulated the criminal reconciliation system.However,the research and controversy about the criminal reconciliation system has not been settled,and some problems still exist great differences.There are different opinions about the scope of application of criminal reconciliation.Including minor criminal cases,juvenile delinquency and exclusion and so on.The scope of application of criminal reconciliation is a very important issue,the narrow scope of application,it may result in the efficiency value of criminal reconciliation can not be achieved;a wide range of applications,but also will affect the effective realization of the national penalty power.Therefore,on the basis of a comprehensive study of the theory and practice of the criminal reconciliation system in our country,the author puts forward some practical suggestions on the scope of application of criminal reconciliation in our country,which is of great significance to the construction of the rule of law in our country.
