Under The Marxist View Of Justice, The Procuratorate Went To The Study Of Administrative Reform

With the development of economic,the issue of judicial justice is becoming the focus of the people.while wrongly-charged cases also revealed the defects of the judicial system.Under the background of deepening comprehensive rule the country by law,promoting the social justice,reforming the judicial system,and perfecting the legal system is becoming the main contradiction which needed to be solved in the process of social development.Based on the basic principles of Marx's philosophy,this paper studies the reform of the Institute to achieve fairness and justice as value orientation under the guidance of Marx's idea of justice.This paper mainly studies justice content of the Marx's concept and its guidance to the administrative reform of the procuratorate.The author sums up the similarity of reform of "de-administration" depending on teasing relevance of people's procuratorate reform measures,and depending this main line,study reform Direction,path and concrete measures of "de-administration" in the perspective of marxism justice viewpoint.For a long time,as judicial organs,people's procuratorate have been running the procuratorial with the nistrative system and mode.Administerization on institution setting,judicial cases,prosecutors management restricted the procuratorial organs to perform the judicial authority.It has important theoretical meaning for how to remove the abuses of administration,standardize the distribution of judicial functions and powers and establish judicial personnel management,authority operation and power supervision system conforming to the judicial law.The procuratorial reform reaches wide scope and consists lots of contents,making a massive reform of the original procuratorial mechanism,institutional setup and personnel management.The characteristics of inevitability,practicality,and not eventually designed of the procuratorial reform endow it high practical significance.This article is divided into three parts.The first part sums up the basic content and judgment principle of Marx's view of justice,and outlines the value orientation of procuratorate reform;in the second part,the author generalizes characteristics of the justice realization of the procuratorial power and summarizes the performance of procuratorate administration,analyzes the reasons of administration orientation to the realization of procuratorial judicial power functions,and summarizes the people's procuratorate function orientation,organization setup and the prosecutor training and selecting.At the same time,the paper states the negative impact of administration phenomenon;The third part studies the administrative reform of the procuratorate under the view of judicial justice and analyzes the direction of the procuratorial reform of de-administration,analyses the necessity of the reform as well as affirming the current procuratorial system advantages.Learning the analysis of the judicial reform measures of the central deployment,the author sums up two directions of the reform: perform procuratorial authority independently according to law,and perfect the procuratorial mechanism.And also,studying the path design and the specific measures of the reform under the integral direction of the reform,connecting with the practice of reform experience,to propose the concrete scheme of de-administration reform from the angle of practice.In every reform goals or reform measures,to propose “the easier,priority to the easy ”reforms and the reform of the transition period,and be prepared to change for the existing personnel system,expecting the measures of reform put forward steadily and smoothly,and reduce the inadaptability and negative impact of reforming dizzily,making the good design of procuratorial reform into superior execution on practice level.
