December 27,2015 the Twelfth National People’s Congress,People’s Republic of China Standing Committee of the eighteenth meeting of the "People’s Republic of China anti domestic violence law",the category of domestic violence was in the form of law for the first time.Among them,victims of domestic violence can protect the personal safety of applicant that has become a big strength.Compared with 2008,the research and application of China law issued by the Supreme People’s court "involving domestic violence marriage case guide" for the first time the personal safety protection order system into China since the "People’s Republic of China anti domestic violence law" after the implementation of the application and issuance of personal safety protection order number is significantly increased,more women know how to pick up the legal weapons to protect themselves;however,can not ignore the fact that the violation of personal safety protection order occurs,order execution,protection scope and effectiveness of personal safety protection is worth another look.This paper focuses on how to "protect the personal safety of anti family violence law" in order,based on family violence protection order and the concept of the origin and development,detailed safety protection of our people to the origin,development and the practical problems encountered.Through summing up the experience of other countries,and then combining with the current situation of domestic practice,this paper puts forward the perfect view from three aspects: the application,the implementation and the responsibility of personal safety protection order.This paper is divided into four parts.The first part is the concept of habeas corpus.First of all,a clear definition of family violence protection order and history;secondly,the safety protection of our country to make the definition,is a court in order to protect the victims of domestic violence are family members against perpetrators of ruling;at the end of the safety protection in China to analyze the development andevolution.The second part is the problems encountered in the practice of habeas corpus in our country.First of all,through the protection of the safety of people make analysis in the scope of application and that the deficiencies in the application level;finally,in practice to protect the personal safety of people make the observance and violation of personal safety protection order after the legal liability should be pointed out that the deficiencies in the practice of personal safety protection effect of actual operation make the.The third part summarizes the characteristics and experience in the application and implementation of the system of habeas corpus in Britain,the United States and Taiwan in china.The fourth part,through the analysis and summary of the first three parts,puts forward some suggestions on the improvement of the system of personal safety protection in China from the aspects of application,implementation and responsibility.
