Patent system is a system of young,it was set up with the fast development of the industry,he founded at the beginning of the purpose is to give the interests of the patent holder to monopoly,in exchange for technology solutions in public,so as to avoid repeat creation activity,and also allow the public to enjoy the technology which raise the quality of life.Chinese medicine belongs to the part of the traditional culture of our country,although it has the old "tag",but the development of which is good.Patent protection for Chinese traditional medicine,it is the best protection for the characteristics of our country enterprise.The scope of the traditional Chinese medicine patent protection,however,there are a lot of problems,there are many reasons for such problems,this paper respectively from the perspective of macro and micro angles to carries on the discussion,to try to find the specific reasons that don’t fit.Then,through the related provisions of the relevant national legislation,try to open the train of thought,and provide effective legislation suggestions,in order to balance or resolve the conflict.
