Criminal Law Protection Of Citizens' Personal Information Security

In this paper,two typical cases of personal information against citizens as the starting point,through the analysis of the case to get the focus of controversy.In order to solve these controversial focus,this paper first briefly explains and analyzes the basic problem of the concept and connotation of citizen's personal information,and puts forward his own view.After a clear understanding of the concept of personal information of citizens,the author further emphasizes the necessity and urgency of the criminal law involved in the protection of personal information of citizens.On the basis of this,the paper focuses on the criminal legislation of our country and the adjustment of the crime of infringing upon the personal information of the citizen in accordance with the "Criminal Law Amendment IX",taking the "Criminal Law Amendment VII" as the background,focusing on the existence of the objective elements The author puts forward the corresponding rationalization suggestions on how to determine the "citizen's personal information" and "the seriousness of the plot" in the judicial practice.Finally,from the point of view of the macro-legislation,the author analyzes the illegal use of the citizen's personal information Behavior without criminal law to make recommendations to improve the problem,in order to achieve more perfect criminal law to protect the personal information security objectives.
