The pedestrians running red light phenomenon that becomes a problem of modern urban governance is very common in many cities of our country,and this phenomenon has a great challenge to people's health and the road traffic order.Although we can't rule out there are some pedestrians who don't know the traffic rules of running red lights,but most of the pedestrians who run red lights know the basic rules,which actually shows that the current law for the regulation of pedestrians running red lights and punishment measures doesn't work well,and only relying on the current laws and regulations to govern the pedestrian running red light phenomenon has been difficult to achieve the ideal effect.So nowadays many cities have a "coup" to control this phenomenon,the "coup" has certain governance effect,and at the same time there are controversy over the legitimacy and rationality of these measures,which resulting in these measures is difficult to implement for a long time.This article makes in-depth research on this issue through four parts.The first part introduction discusses the research significance and legal position of pedestrians running red lights,and summarizes the research status at home and abroad,and introduces the research methods and innovation and deficiency of this article.The second part of this paper is social survey research of the pedestrian running red light,the author makes a practical investigation in order to further study the related questions of the pedestrian running red light phenomenon,mainly includes two aspects,namely the field survey and filling in the questionnaire,the field survey is a busy city road chosen to look at the traffic intersection,and the questionnaire survey(a total of 200)is published online to be filled out,on this basis,through the analysis of the results,and sums up the characteristics of pedestrians running red lights,reasons,punishment and governance issues,which laying the foundation for further research of this paper.In this paper,the third part is about the domestic and foreign typical cities for combing and analyzing the problem of pedestrians running red lights law enforcement,the problem of domestic major cities pedestrians running red lights will be divided into concrete method of"punishment inside the law" and "punishment outside the law”,each mode's major cities,specific measures and implementation effect will be listed and analyzed,finally each mode of administrative law enforcement will be analyzed from the "legitimacy","rationality" and "effectiveness" three angles.And the typical abroad urban governance model will be listed to provide experience to explore the reasonable way of governance.In this paper,the fourth part is analysis of the administrative law about the pedestrians running red light management in our country,which can be divided into deep reflection,rational thinking and future vision,in-depth reflection refers to through the analysis of the existing penalty function of three specific performance,to explore the existing four specific causes for the lack of penalty function,to reflect on the existing functional lack of administrative penalties;Rational thinking refers to discussing the law of legislation of running a red light to excavate the way of improving existing administrative law enforcement that is increasing illegal cost;Future vision is to improve the existing running red light punishment system by seven changes,namely to enrich penalty categories: from single to diversity;To strengthen the degree of penalty: from "weak" to "strong";To refine the punishment range: from generalization to classification;To improve the way of payment: from the scene to behind the scenes;To carry out the punishment rules:from "virtual" to "real";To use a variety of management methods: from chaos to specification.
