Research On The Scope Of Government Information Disclosure By Public Security Organs

As information disclosure being the necessity for the building of a law-based public security force, what types of information can be categorized as government-related and subsequently be publicized is the prerequisite and fundamental question for government information disclosure. The information of public security organs has features such as large volume, high confidentiality and disclosure required for individual cases. Disclosure of public security organs began in the 1980s and the scope of disclosure has been continuously expanded since the implementation of Regulations on Government Information Disclosure and the issuance of Regulations on Law Enforcement Disclosure of Public Security Organs.By examining the current practice of public security organs via the general situation of information disclosure and information publicity litigation, it is found that the disclosure is plagued by issues of high self-discretion, difficult to identify government information, disputes over the matter of non-disclosure information, lack of response for hot-spot issues, dilemma of criminal investigation disclosure and insufficient treatment of non-normal applications, all of which result from the unclear definition in the regulation, conflicts with relevant laws and regulations, incomplete information disclosure mechanisms, unregulated law enforcing activities and shallow study of these theories of disclosure. Combined with the illumination of outbound experiences, this paper provides several suggestions to improve the disclosure scope of public security organs. Criminal law-enforcement information shall be included within Regulations on Information Publicity, whereas those for non-disclosure shall be fully listed and activities of abusing publicity application shall be lawfully inhibited. When it comes to implementation, the public security organs shall launch related specifications, specify contents for proactive disclosure, integrate publicity into more regulated law-enforcement and further disclosure of police data.
