Research On The Implementation Problems And Solutions Of Dangerous Chemicals Management Systems In China

As one of the most important chemical components, hazardous chemicals are playing a more and more important role in people's life. However, due to the fact that the dangerous chemicals are flammable, explosive, toxic and harmful, corrosive, it is easy to cause a safety accident, therefore lead to great damage and loss. As a result, the safety management of dangerous chemicals has become an important topic around the world. Since the last century, The United States, the European Union and Japan has begun to build the legislation of chemical safety management, and the formation of the legal system of safety management of hazardous chemicals in line with their national conditions. The United Nations has also issued Globally Harmonized System of Classification and Labeling of Chemicals,Rotterdam Convention on the Prior Informed Consent Procedure for Certain Hazardous Chemicals and Pesticides in International Trade and other series of agreements and conventions. China has also enacted a series of laws and regulations of the safety management of hazardous chemicals, such as the promulgation and implementation of the "People's Republic of China production safety law" enacted in 2002,the "dangerous chemicals safety management regulations" revised in 2011. As for the safety management of hazardous chemicals, China has formed a relatively thorough legal system.However, in recent years China's dangerous chemical safety accidents still occur frequently. While the Ruihai explosion happened in Tianjin,August 12, 2016 has made the government and the public realize the fact that the implementation of safety management of hazardous chemicals still exists many problems. Because of the lack of analysis of China's hazardous chemicals safety management system, the effectiveness implementation of the hazardous chemical safety management system is of theoretical and practical significance.This paper consists of five chapters. Firstly, the author tried to summarize the current safety management of dangerous chemicals and special laws and regulations system, to introduce the history of China's dangerous chemicals management system, and to explain the management system for hazardous chemicals. Secondly, the author points out and analyzes some problems existing in the implementation of China's dangerous chemicals management systems, specific from the compliance of practitioners, employment approval assessment, administrative law enforcement supervision, information technology, emergency measures,accident accountability and other aspects. Thirdly, the author analyzes the possible problems in the implementation of the management system of hazardous chemicals in China, and analyzes the possible causes of these problems. In the fourth chapter the author introduces the safety management system of the United States, the European Union and Japan, and find the reference solution to solve many problems in the implementation of China's dangerous chemical safety management system. Lastly, after the analysis of the existing problems and reasons, learning from foreign advanced experience, combining with the existing system and the specific situations of our country, the author puts forward the effective countermeasures of the implementation of China' s hazardous chemicals management system.
