| As everyone knows,China is a unified multi-ethnic country.Han and other fifty-five ethnic groups together to create great Chinese civilization.Due to the influence of imbalance of various factors such as historical reasons,geographical conditions and economic development,has long been in the minority areas there are ethnic customary law.Customary law of ethnic minority is minority people in production and life in the spontaneous formation of product,is between nation and nation in order to maintain the social order,adjustment,in handling the people’s relationship,by the members of the society of common recognition,applicable in certain areas within the scope of the standard,and the essence of the code of conduct is a kind of social order in violation of the destroyer of the punishment mechanism.It is all ethnic groups in the long-term production and life of the cultural heritage,it inherited the development of national culture,the trajectory and the achievements of the development of national culture.The customary law of ethnic minority as a kind of customary law,prevalent in the minority areas,is "the living law".The customary law of ethnic minority in maintaining social order and the cultivation of social roles,cultural heritage and other aspects have important value.At present,the modernization of the legal system is constantly advancing,however,due to the impact of western legal value centered,in advancing the process,more just to fit even completely absorbed western legal values,and in a certain extent,ignored the essence of Chinese traditional legal culture and local law resources that may cause thevalue and efficiency value has carried on the analysis,and then specifically pointed out the minority customary law in the construction of rule of law,the value implication.Finally put forward the specific strategies to enhance the value of the minority customary law,hope that through this study,can initiate contribute to research in related fields. |
