Research On The Violation Of Property Privacy In The Era Of Big Data

Today’s society has entered the era of big data, the operability of the technology of big data, the mass of data information and its free liquidity had dramatically changed our way of life and brought a lot of convenience to our life. But using big data technology for data mining on the citizens’ personal information on the Internet is also gradually becoming a challenge to citizen right of privacy, which cause legal issues are also unprecedented. The concept of privacy has been very complicated , and in the era of big data, information exposed, privacy expanded, the connotation of privacy is more complex, digital technology is more difficult to control, if we want to protect privacy, we must rethink our understanding of the right of privacy.Since 2012, the big data has become a hot issue of common concern to scholars from all of the world, and the questions about users of Internet privacy infringement which triggered by big data era is also getting more and more attention from various disciplines professionals. Any new technology could lead to "pain". Online privacy has long been a problem, the advent of the era of big data makes the Internet a veritable"inspection office", and also adds many new features to online privacy. One of the prominent characteristics of it is that online privacy has enhanced properties, specific displays in: one is putting the privacy directly as property transactions, the other is to discover its economic value of privacy. As the era of big data privacy in the Internet environment has the characteristics of commercialization, mass network information,rapidly spreading, low cost and wide audience, along with the more mature big data technology, the infringers collect, steal, record, analyze, spread and sell citizens’valuable privacy, and gain economic benefits. Citizens in the era of big data network who have privacy infringement, not only have mental pain, but also might have damage to property. In this context, the author tries to put forward the concept of "property right of privacy", basing on this new concept, exploring the new characteristics of infringement about the citizens right of privacy on the Internet during the era of big data.This article mainly take the literature research and comparative research, through analyzing and comparing the privacy protection mode all over the world ,summed up the characteristics, forms, constitutive requirements and reasons of property right of privacy.According to the development of China’s national conditions, the author tries to explore the big data age citizens property of privacy protection strategy from the citizens,enterprises and the national three aspects.
