The fast development of digital information and general application of computer science greatly benefit people from all around the world.It changed the way people communicate and spread information,and was almost applied to every aspects of daily life including but not limited to politics,economy,culture and science.In the meanwhile,we have to notice that,with all the convenience and benefit of digitalization,a new category of criminal activity based on the internet had arisen and endangered the society as a whole.In solving cases of such crime,electronic evidence forensics were acknowledged by investigation and litigation and gradually become a new evidence type in the litigation.Electronic Evidence,as the product of new era,is obtained in a quite different way from the traditional evidence collection.Starting from defining the electronic evidence,this article by means of comparative analysis will elaborate theoretically on the relevant issues of electronic evidence in investigation.It also provides rational advise for digital forensics with reference to legislation precedent of other countries.This article studies the electronic evidence forensics in investigation from three aspects.First of all,it discusses the theoretical basis of electronic evidence,namely,the concept and the role of electronic evidence and its characteristics on the impact of evidence.Secondly,by means of studying current practice of investigation,this article argues issues arisen from electronic evidence forensics such as the incompliance with standard operation in terms of subject,technology and tools of evidence collection as well as potential harms on civil rights during the collection process.Thirdly,this article,comparing and analyzing domestic and international legislation,provides advice and action plans on legislative improvement,standardization of procedure,subject and technology of evidence collection.
