Research On Standardization Of Electronic Data Forensics In Criminal Cases

With the rapid development of modern information science and technology,human society has entered the information age,and criminal activities have begun to spread to the virtual world of the network.How to effectively combat cybercrime and prevent cybercrime has become an important issue in modern social governance.Computer network crime is characterized by high technology and strong professionalism.It needs profound forensic technology foundation and strong professional background.Forensic technology,methods and means are facing severe challenges.However,in judicial practice,there are numerous cases of defective or disqualified evidence in electronic data due to the irregular collection of evidence,and even more,the destruction of key evidence,resulting in irreparable losses.This article will focus on the "case" and discuss the four servers of key evidence and their storage of obscene video files by making use of criminal judgments and open court trial information on the internet.It will analyze the authenticity,relevance and legitimacy of the evidence and use it in accordance with relevant laws and regulations of our country and judicial practice.Case study method and comparative study method are used to analyze the irregular behaviors in the electronic data forensics.By introducing and commenting on the theory of authenticity,relevance and legitimacy of electronic data,this paper demonstrates the positive role played by electronic data in restoring the facts of cases,proving the facts of crimes and seizing criminals,and how to standardize on-site investigation,extraction,collection,identification,analysis and transfer of electronic data to custody.This paper explores the standardization process of electronic data forensics,evades the legal risks in the process of electronic data forensics,and discusses the standardization construction of electronic data forensics.
