A Review Of The Basic Principles Of Economic Law

The basic principles of economic law is a fundamental theoretical problem of economic law. It embodies the essential spirit and pursued value of economic law and it is an important symbol for economic law as an independent department law. It has important meaning and value for the theoretical construction and practical operation of economic law. Scholars have made a lot of useful research and discussion on the basic principles of economic law. They study the basic principles of economic law are based on their needs to construct the theories,that is to say,their studies on the basic principles of economic law are abstracted from their own understanding of the adjustment object of economic law,the essential spirit and pursued the value target and so on. So it is inevitable that the basic principles of economic law are influenced by the basic theories, different basic principles of economic law are based on different theories systems. It is not difficult to find that the constructions of the basic principles of economic law have their own unique views in their theoretical systems. Result in too many basic principles of economic law in the field of economic law, and opinions are different on that issue. But it is undeniable that a variety of basic theories and ideas are gradually approaching or converging, a consensus has been reached on the basic principles of economic law after the discussion on the basic principles of economic law in the field of economic law. This paper is based on the current research of the basic principles of economic law, by reviewing and analysing the views of their studies about the basic principles of economic law, particular emphasis on the theoretical height to make a further analysis on the establishment of the basic principles of economic law, throughout the basis of summarizing the research achievements of the basic principles of economic law. This paper is also focus on three basic theoretical problems in the construction of the basic principles of economic law: Firstly, the development of the basic principles of economic law under the evolution of China's economic system. Secondly, the relationship between the basic principles of economic law and the regulated objects of economic law. Thirdly,set forth the basic principles of economic law should reflect the value orientation of economic law -- social public interest and other issues. I want to achieve a research-positioning on establishment of the basic principles of economic law and the construction of the system on the other theoretical problems. Through the exposition of this paper, I try to make the basic principles of economic law can be further studied in depth by taking the relevant theory about the basic principles of economic law as the starting point under my research.
