Research On The Construction Of Economic Rule Of Law From The Perspective Of Morality

In the planned economy,China's economy shows the predominance of government and centralization. However, after the reform and opening up, the complicated market requires the market economy. The market cannot development healthy without law. Economic rule of law ensures the order of economic freedom,equality and fair competition necessary for market operation. Therefore, it is necessary to implement rule of law. But as we know, relying on the rule of law to solve economic problems is not the same as the direct derivative some legal norms,we need considering many factors on the path of the rule of law in which the role of morality is very important. At the moment, Our country's rule of law about economic situation is not very ideal, the imperfect rule of law can't ensure the market economy and harmonious society, so from the perspective of ethics to inspect the rule of law about economic in legislation, law enforcement and judicial and law-abiding process carries on the discussion and analysis,main purpose is through the moral effect on the economic rule of law, desire finding the method to solve problems about economic law from moral perspective.The importance of morality to the construction of economic law is self-evident.At the beginning of this thesis is an analysis of a situation of economic law, his definition, achievements and problems; then discusses the logical starting point for the construction of the economic law. What is the good economic law, his importance to market economy and the moral how to make the good economic law is possible.Moreover, we discuss the function of moral to law application, mainly focuses on the importance and specific representation of law enforcement and judicature. Finally,morality provides the moral guarantee for law-abiding,and makes the law change from external compulsion to internal moral consciousness. Only with morality as the support and the rule of law as the guarantee, equal, free, fair, competitive and harmonious and healthy economic environment of the market economy can realized earlier.
