Research On The Legal Issues Of Land And Sea Transport Between China And South Korea

Both China and South Korea are on the verge of the sea.The advantages of geographic location make frequent trade and economic exchanges between the two countries.And China once become the important goods import and export countrie of the South Korea.Since the two countries signed the agreement on the carriage of goods by sea transport vehicles to China and South Korea,the seamless connection of combined transport and high-speed and efficient freight to further promote the economic and trade exchanges.We can approve the goods combined transport advantages,and at the same time we cannot ignore the problems.Since the sea transport opens,various legal problems exposed.However,the two countries research this kind of mode of transportation from technology and management,involve legal issues rarely.And there are not the unified related international conventions.Therefore,this article makes up for the loopholes in time,fillsthe blank of the law and promotes China and South Korea trade and shipping development,it also has important research value in theory.This article mainly expounds from four aspects.First,narrativing the situation of law making for sea transport to China and South Korea at present.Combing th law from South Korea,China's domestic laws and international treaty and practice.Second,Studying China and South Korea sea transport law.This part is mainly studying multimodal transport operator between land ang sea,the goods,shipping and port goods handling,discussing the relationship between the research on the basic legal relations and the rights and obligations of the parties,pointing out its legal risk and putting forward to the solving measures.Third,China and South Korea sea transport applicable law research.This section is based on different points of discussion of the parties.It can be applied in the process of dispute resolution law and put forward suggestions on the risk situation.Fourth,sea transport insurance.This part analyses the current insurance law,analyses of problems and puts forward solutions.
