Research On The Legal Issues Of Renewal Of The Right To Use Residential Construction Land In China

In 2007,our country issued and carried out The Property Law,in which put forward the concept of the right to use land for housing construction firstly and made it refined and applied into different renewal systems in accordance with whether the building for home use or not.Among them,the the housing renewal adopts the principle of the automatic renewal rule to use construction land,but there is no legislative provisions about the automatic renewal,such as the scope of application,the renewal,whether or not should pay the corresponding consideration and the renewal of the specific procedures and did not make further provisions.And it is lack of maneuverability in practice.Several years later,our country will face more the using expiration of housing construction land,renewal problem will face a major test,then we must be able to take out a set of compelling and effective renewal scheme.Therefore,it is necessary for us to discuss the legal issues associated with renewal.About housing renewal of the legal issues of the right to use construction land mainly from two perspectives.firstly,automatic extension rule of plan;second,who will get the renewal buildings on the ownership of the situation on the ground.This article starts from the concept of time system of the right of the construction land,learns the origin of term system of residential construction land and legislative status,analyzes the shortcomings of our current legislation in our current legislation in our country,By comparing the surface right renewal system of continental law system,some suggestions will be put forward about the expiry of the period of the right to use construction land problems.
