Research On The Renewal Of Residential Construction Land Use Right

The renewal of the right to use residential construction land is related to people’s happiness,social stability and long-term stability of the country."The People’s Republic of China town state-owned land use right grant and transfer provisional regulations" article 12 stipulates the highest number of years of construction land use right,residential land 70 years,so after 70 years,how to solve the ownership problem of the house? On January 1,2021,the Civil Code of the People’s Republic of China(hereinafter referred to as the Civil Code)was officially promulgated and implemented.In the Civil Code,the renewal of the right to the use of residential construction land stipulates: automatic renewal.But how to renew it,is it a paid renewal or a free renewal?There is no specific regulation on the length of the renewal period.In view of the above problems,this paper studies the renewal of the use right of residential construction land.Through typical case leads to the problems of the residential construction land use right renewal and causes,clear the legitimacy of automatic renewal and not renewal exceptions,through the theory of free renewal and paid renewal,clear the residential construction land use right paid renewal,and put forward the specific rules under the system of paid automatic renewal.
