Research On The Legal Issues Of Reputational Infringement Of Weibo

Compared with the traditional reputation,in fact,micro-blog reputation is not a new thing,there is no real difference between the two.micro-blog to the Internet as the carrier,created it spread fast,the impact of a wide range of features,while bringing the convenience of infringement in recent years,micro-blog reputation infringement cases endless.In the application of the law,there is no specific legislation to regulate it,always invoke the relevant laws and regulations,but these laws and regulations can not clearly define whether the infringement,in the judicial practice,the judge did not have a clear basis for the case,micro-blog infringement law applies to an embarrassing situation.In this case,how should we find a way out? Faced with this situation,I try to try from shallow to deep,and gradually expand the protection of the rights of micro-blog discussion.The first chapter of the paper starts with a case and leads to some personal insights.The second chapter discusses some basic problems of the micro-blog reputation right,which paves the way for the later research,and also discusses the causes of the micro-blog reputation infringement.The third chapter analyzes and concisely analyzes the responsibility and commitment of micro-blog reputation infringement.The fourth chapter focuses on the legislation of micro-blog reputation infringement at home and abroad,and analyzes the embarrassing situation that the law of reputation infringement applicable to traditional meaning does not apply to micro-blog infringement.Finally,some relevant legislation and theories about the protection of the reputation of micro-blog in foreign countries are put forward,and then the perfection of the protection of reputation infringement in China is put forward.
