It is always a complex issue in the attribution of conducts in the UN Peacekeeping Operations.Combined with the current situations of UN Peacekeeping Operations,this article summarizes thestandards on applying the principle of “effective control” to the attribution of conducts in UNPeacekeeping Operations,which is based on the analysis of Draft Articles on the Responsibility of International Organizations and its commentaries adopted by International Law Commission in 2011 as well as relevant cases.Furthermore,this articlecompares and analyzes the “overall control” standard in the judgement of Tadi? case made by the International Criminal Tribunal for the former Yugoslavia.Finally,the article concludes thatthe specific standard of applying principle of “effective control” to a certain case depends on whether UN exercises the overall control towards the specific UN Peacekeeping operation,and whether the chain of command and control made by UN is obviously violated in the case.
