On The Improvement Of The Probation System In China

The probation system is the system which allows criminals to remold their ideology through conditional in-execution of the original sentence.It effectively avoids the disadvantages of short-term free sentence,and more conducive to helping perpetrators to reintegrate into society and education in remolding.The criminal law of China provides for two kinds of probation systems including general probation and wartime probation.Criminal Law Amendment(viii)has modified and improved the conditions of sentence with probation in the general probation system.The "Measures for the Implementation of Community Correction",and made corresponding provisions for perpetrators how to apply and how to perform probation,but in the specific implementation process,there also exist problems such as poor operability and large arbitrary.This paper,mainly from the present situation of the probation system of China,based on the Criminal Law Amendment(viii),makes an analysis of the problems and defects existing in the probation system in China,and gives suggestions and measures in improving the probation system,in order to facilitate the progress and development of the probation system.This article is divided into four parts.The first is about the probation system,and discussing it chiefly from the definition of the probation system,and the significance of the probation system,and provides my understanding of the value of the probation system.The second part is about the introduction of foreign probation system.The three part is on the status of the probation system of China,making an analysis mainly from the application of probation,the supervision and inspection of probation,and the deficiencies of probation,to understand the problems and the directions in the need of improvement in the probation system of China.The four part is on the improvement of the probation system of China,giving suggestions and measures of improvement mainly from the application of probation,the supervision probation the probation,and the revocation of probation,offering advice and suggestions.
