Research On The Legal Protection Of Online Group Purchase Consumer Rights

With the development of e-commerce,people all around the world gradually changed the ways they live.Groupon,also known as group buying,as a brand new consuming pattern which beloved of teens and adults,entered Chinese market at 2010.Groupon renders us lots of excellent consuming experience,however,it brings to us several problems.Some dilemmas,such as price,privacy and safety troubled us consumers more or less.China doesn't have enough laws and articles to regulate Groupon.Though the 2014 Consumer Protection Act added several clauses regarding Groupon,it is not a concrete and comprehensive one,which leads to lots of problems unsettled.At the same time,although we can seek remedies from other laws besides the Consumer Protection Act,those articles have a bunch of limits.For example,those clauses tend to be low-level ones compared with other laws such as Criminal Law,Civil Law.They cannot be operated properly.Therefore,they fail to protect our rights and privileges in a functioning way.This article,starting from consumer protection,demonstrates my point of view in four sections.First,the article illustrates the concept and situation of nowadays consumer protection.It goes from concept,patterns and characters of Groupon to subject and legal relations.In the end,it describes conditions of consumer protection in China.Second,it discusses legal problems of consumer protection.It starts from legislation and administration.Then the paper enumerates some cases to discuss the how to deal with torts and remedies.Third,this paper analyzes how to improve consumer protection from foreign outlooks.Some countries,such as United States,Australia,European Union and Germany can give us lots of experiences when facing abovementioned problems.Finally,the passage carries out some useful opinions for how to ameliorate our condition.On the one hand,we can put more efforts in legislation and administration,finding out ways to complete those regulations.On the other hand,try to figure out how to better protect consumer rights from the angle of remedies and torts.In order to build a functioning and comprehensive consumer protection system,we must concentrate on those four parts.
