Research On Consumer Protection In Overseas Purchasing

With the rapid development of China's Internet technology and the rapid growth of social economy.Nowadays,people's growing needs for a better life and the pursuit of new things have created a booming overseas purchasing industry.More and more consumers are no longer limited to domestic consumption,and are more willing to go directly through the network.Platform or private purchasing method to buy foreign products with good quality and low price.Indulge in a richer overseas purchasing products.This newly added population and consumption patterns have become an important part of current social life.The huge market for overseas purchasing has spawned some online purchasing platforms,micro-businesses and online purchasing companies in China,and this online trading model has greatly filled the shortage of the physical store model.At the same time,however,some lawless elements have also seen "business opportunities",resulting in the proliferation of counterfeit and shoddy products,shoddy,large-scale doping or even adulteration of purchasing goods,often occurs,such as fake charges and other infringements.It is not uncommon.These illegal acts are constantly infringing on the legitimate rights and interests of consumers.At present,many of the rights and interests of consumers in overseas purchasing can not obtain effective legal protection,which should cause us to be concerned and vigilant.This article will combine China's "Consumer Rights Protection Law","People's Republic of China Cyber Security Law" and the recently promulgated "E-commerce Law" and other relevant laws and regulations,from the perspective of consumers,carefully observe overseas purchasing consumers should enjoy the rights and interests,and at the same time analyze the shortcomings of overseas purchasing consumer rights protection,and explore what measures overseas purchasing can take to further enable consumers to obtain more and better protection of rights and interests.Apart from the introduction and conclusion,this paper is divided into four parts.The main contents of each part are as follows:The first part introduces the concept of overseas purchasing,the form it exhibits,what characteristics it has,and the different legal situations in which it explains the participants in the overseas purchasing transaction and the legal relationships between them.The rights that should be enjoyed in purchasing or the obligations that should be fulfilled.The role of the first part is to let the readers have a preliminary understanding of overseas purchasing or to lay the foundation for further development.The second part is to tell readers the contradictions highlighted in the current overseas purchasing process.The various infringements that consumers may face in overseas purchasing or the various legal issues involved and the reasons for analyzing these problems are as follows.The targeted consumer protection relief provided provides targeted guidance.The third part is to consult the foreign regulations on the protection of consumer rights in overseas purchasing,and it can bring us some inspiration while drawing lessons.The fourth part mainly proposes to improve the protection of consumer rights in overseas purchasing,and tries to make effective suggestions from four aspects: legislative protection,judicial protection,perfect overseas purchasing supervision system and social protection.Summarize how to ensure the effective supervision of overseas purchasing,and promote overseas purchasing sustainable,harmonious,healthy and stable development.
