With the emerging of the impact of international financial crisis and down going of world economy status.China needs further opening in financial fields to guarantee economic order,efficient distribution of resources and in-depth integration between markets.Banking plays a substantial part in opening to foreign capital.However,banking is the very basis of financial economic operation and domestic economic operation.When bad operation state or crisis emerges,it not only affects the stable development of financial market,but also spread to the whole domestic economy,Thus,to study banking supervision and regulation in a legal aspect has substantial meaning to the stable and healthy development of banking industry.This essay studies foreign banking in three chapters.The first chapter introduces China's economic status and what a foreign bank can bring.The second chapter features a comparative study of foreign banking between China and the United States in the different requirements of entering the market,operations and market withdrawal.Compare the differences from legislation of supervision,authorities responsible and the extent of supervision.Finally,the last chapter discusses some existing problems of Chinese foreign banking system and emphasizes analyzing American advanced legislation experience in both systematic and technical aspects related to risk preventing.
