Cyber ??harassment And Freedom Of Expression

With the advent of the Internet age,the transmission of information and communication content is more dependent on the network media.However,the problem of network harassment has become increasingly prominent,in the anonymous network,many Internet users wantonly published malicious statements,known as troubled Internet users and threats to social security risks,which the traditional freedom of expression presents a new challenge,freedom of expression is the fundamental right of Constitution gives citizens.The author analyzes the connotation extension of expressive freedom and its restriction and discusses the boundary of freedom of expression in the network environment.And then analyzes the relevant problems from the perspective of comparative law and the experience of Canada and its reference.This paper analyzes the essence of the problem of network harassment,such as network tracking threat,online criminal harassment,cyber bullying,and so on,as well as its ability to express the opposite of freedom from the recent Canadian first harassment case R.v.Elliott.This paper discusses the issue of freedom of expression in the new network environment by comparing the legislation and its protection in China and Canada,and expands the horizon and perspective of thinking and thinking.It is considered that the important symbol of network harassment is injury and reasonable fear.Although Canada is an Anglo-American law system,but the relevant legislation and a lot of case-based reasoning analysis for the study of network harassment and freedom of expression of the border issue still has great theoretical and practical significance.In the end,through the introduction of China's current network harassment legislation,the author found that China has not yet improve the criminal harassment legislation and other issues.There are some legal provisions of the deficiencies and made the relevant personal recommendations.
