Modern society is the information society,modern management fundamentally depends on information management.The government information publicity,is the modern government to serve for the purpose of providing a public service.Since the late 20 th century,with the public's awareness of rights,the main body consciousness obvious enhancement,knowledge,participation,expression and supervision of the desire of the government administration is increasingly intense,the vigorous development of the theory of the rule of law,the government information disclosure work presents the trend of globalization.On May 1,2008 implementation of the law of the People's Republic of China government information disclosure regulations marked the our country government information work toward legalization.The government information openness system according to application has also been more and more people's attention.The implementation of government information openness system according to application,has realized the public from passive recipients of government information to take the initiative to get transformation.But due to the imperfect legal system,outside the normal information application,some applicants use of the existing legislative loopholes brought a large number of improper application,to the administrative organs bring no small pressure.Therefore,under the condition of the citizens' right to know,to clarify the connotation and cognizance standard of government information right abuse,restrict administrative organs in the discretion of the government information disclosure work,guide citizens rational apply for government information publicity is very necessary.Based on the research object of MSA in Shanghai,through the implementation of the government information open according to application present situation description,found imperfect legal system construction of the government information publicity,the administrative organs of the lack of public awareness and citizens apply for improper purpose are the important cause of frequent disclosure right abuse.Therefore,the problem of the abuse of government information application is to reconstruct the government information public legal system,innovate the service mechanism of the administrative organ,and guide the application of civil rationality.Therefore,we will promote the construction of an open,transparent and efficient socialist legal government.
