There are still imperfections not only in system infrastructure but also in practice in the information disclosure system of current bankruptcy law. Through comparative analysis between foreign legislative processes and the present legislative situation in China, this paper seeks to expound important conceptions of the information disclosure and related systems in bankruptsy and securities law. It discusses how to construct a better disclosure system from aspects of disclosure of principle, content, degree, time and the final legal remedy, including core elements of rules governing the information disclosure system. From the prospective of corporate governance, the paper attempts to build a new theorical framework of the information disclosure system in bankruptcy law. From the prospective of the balance of interest, a main goal of this paper is to set up a scale between debtors, creditors, bankruptcy administrators and other participants in bankruptcy proceeding. From the prospective of improving the judicial credibility, this paper will address the urgent need for shaping and promoting the judicial credibility to public satisfaction. From the prospective of combining theory and practice, this paper will analyze the imperfections of the information disclosure system of bankruptcy law using current legal. In conclusion, this paper attempts to provide a new system infrastructure for the establishment of legislation in information disclosure. Furthermore, through a series of creating and improving rules, this paper hopes to contribute to the progress and perfection of bankruptcy law theory and practice.
