Research On Liability For Damages To Passengers In The Network

With the acceleration of the urbanization process,the Online Car-hailing has come into being.Although the Online Car-hailing can solve the difficult problem of taxi effectively,it also caused a series of problems,such as the passenger's personal injury claim.This article uses the case to elicit the legal issues that related to the existence of Online Car-hailing,analyzes several operating modes of the Online Car-hailing,and the legal relationship between the parties in the different modes of the Online Car-hailing.This article discusses the liability principle of Online Car-hailing Tort Liability,the liability principle of Online Car-hailing Liability for breach of contract,and liability for damages.It was clear that the Online Car-hailing platform should bear the responsibility of the carrier.Then according to the relationship between the entities in the different models of the Online Car-hailing,it was determined whether the Online Car-hailing platform had the right of recourse.On this basis,the paper believes that the protection of the legitimate rights and interests of passengers on the Online Car-hailing should be strengthened from the aspects of strengthening the protection of information security,strictly controlling the access of drivers,and creating related insurance.
