Research On The Administrative Legal System Of Cultural Relics Protection In China

China's current administrative law system for cultural relics protection can not meet the needs of our national cultural relic resources and large demand for protection.At present,the domestic scholars study the administrative legal system of cultural relics protection,which mainly focuses on the research of the basic problems of the administrative legal system,and lacks the related research on the comprehensive problems of the administrative legal system.The main problems existing in the administrative legal system of cultural relic protection in China are as follows: the basic principles of the protection of cultural relics and cultural relics are not clearly defined in the law of the protection of cultural relics;in the administrative organization system of cultural relics protection,the main body of administrative law enforcement of cultural relics protection is confused,and the civil and social groups are lacking.A direct and effective way of judicature is to supervise the administrative departments of cultural relics to perform their duties.In view of the main problems existing in the administrative legal system of cultural relics protection in China,the corresponding measures are to improve the existing administrative legal system of cultural relics protection,to perfect the administrative legal system for the protection of cultural relics,to establish the accurate definition of cultural relics and the legal principles for the protection of cultural relics,to perfect the administrative organization system of cultural relics protection and to build up the administrative system of cultural relics protection.The administrative law enforcement agencies for the protection of cultural relics;to improve the administrative public interest litigation system for the protection of cultural relics,and to further promote the protection of cultural relics by the administrative departments of cultural relics protection,and more conducive to the realization of the supervision of the masses.
