In recent years,with the development and popularization of the shared economy,the "online short rent" has been fully developed on the basis of the shared economy of the Internet platform.It uesd a large number of vacant houses,which has the characteristics of convenient,affordable and local experience,and has become a potential industry with great potential in the rental market.But the further development of the industry is greatly restricted by the confusion of management,lack of honesty and lack of legal guarantee system.The author analyzes the existing legal issues through the concept and status quo of online short-term rent.Enumerating the legal disputes caused by the short-term online expounding the existing legal problems in China's online short-term renting,From the perspective of domestic and foreign legal system of short-term rent online.From the pragmatic point of view to improve China's short-term online short-listed put forward specific feasibility recommendations.This article is divided into five chapters.The first chapter is an introduction,which mainly describes the background,literature review and research methods of the thesis.This paper mainly introduces the reasons and methods of online short rent,and uses the case analysis method,comparative analysis method and literature analysis method to analyze the legal problems of online short rent.The second chapter expounds the definition of the online short rent,the reasons for its rise and its current development at home and abroad.The legal nature of online short rent is defined through different theories.Through the current economic situation,the reasons for the rise of online short rent are analyzed.Through the case analysis,the development status of online short rent in foreign countries and in China is analyzed.The third chapter is the legal analysis of the subject of online short rent.This chapter belongs to the theoretical content,and expounds the legal status of the online short rent subject through different theories.For example,the legal analysis of the housing provider,the legal analysis of the online short rent platform,the legal analysis of the relationship between the provider and the online short rent platform,through the analysis of these legal relations,determine the legal responsibility of the subject.The fourth chapter deals with the prominent legal problems of online short rent.The legal structure of online short rent can be roughly divided into two categories: internal legal relationship and external legal relationship.The internal legal relationship mainly involves the relationship between the three users of idle resources,suppliers and sharing platforms.External legal relations mainly involve government regulatory departments,taxation and other issues.The author mainly analyzes the legal problems of online short rent from these two aspects.The fifth chapter is the Enlightenment of the domestic and international online short rent legal system development to China's experience,mainly from the legislative and legal supervision of Taiwan,France,Japan,Canada on the legal system of online short rent.In legislation,all countries adopt a unified legislative mode to manage the online short rental market,and make strict regulations on the qualification of online short rental operators.In the aspect of legal supervision,many countries adopt the form of the third party organization to cooperate with the government to manage the online short rental market.The sixth chapter is a feasible proposal for improving the legal issues of online short rent in China,mainly from the aspects of legislation and legal supervision.The legal system that meets the national conditions,such as the rights and obligations of regulating the online short renting participants,the improvement of tax supervision measures,the establishment of relevant regulatory institutions,and the formulation of strict penalties and elimination mechanisms.
