| “Difficult to execute” is a major problem plagued the People’s Court which causes the strong concern from people and society.It turns to be especially outstanding under the background of the Rule of Law promoting in our country and become the main factor affecting Judicial Authority.In recent years,the civil law enforcement linkage mechanism is an effective way to crack “difficult to execute”.The core of linkage mechanism is deterrence which is achieved through more executive agents jointed,multiple means used in multiple fields,restriction and sanction to personal freedom and rights,social credit rating,to try to limit the living space of the executed.During execution,some problem occurred due to the conflicts of interest between the different departments such as the poor linkage and malfunction of punishment etc..The purpose of this paper is that on the basis of the analysis of civil law enforcement linkage mechanism,to complete the linkage and coordination between different departments,make up the poor linkage and malfunction of punishment in execution,perfect the linkage mechanism of civil execution,so as to to solve the problem of “difficult to execute”.The first chapter introduces the basic theory of linkage mechanism from concept,mature,scope,way of realization;the second chapter introduces the necessity to perfect the linkage mechanism from the current problem “difficult to execute” and request of law construction;the third chapter introduces the existing problems of linkage mechanism and corresponding reason analysis;the forth chapter introduces the advanced experiences of foreign developed countries in the implementation of linkage mechanism and the enlightenment to improve the mechanism in China;the fifth chapter introduces the measures to improve the linkage mechanism from defining legal norms,perfecting the construction of social credit system,strengthening the construction of linkage system,and promoting the long term mechanism construction,with emphasis on the analysis of relevant measures to strengthen the construction of linkage mechanism;the last part is the conclusion. |
