Prison Medical System Research

Under the background of ruling the country and according to law,prison management takes the construction of the rule of law prison as the priority work.Ensuring the medical rights of prisoners is one of the most basic and crucial prison management work,and also highlights the respect for human rights of such people.The funds for medical insurance of prisoners in China are derived from the state financial appropriation,which is a system of public medical expenses.As long as prisoners appear health problems during their sentences,prisoners are provided with medical insurance services to protect their right to life and health.As far as the current prison medical system in the country is concerned,there are three level medical and health network,including the Central Hospital of the prison administration,the prison hospital and the basic medical office,has been formed from top to bottom.Especially after the construction of a central hospital,it plays a vital role in treating critical or dying prisoners and preventing diseases.With the continuous reform of the prison system,many deficiencies in the prison medical institutions have been highlighted.No matter the institution,the system construction,the staffing and the management of the sick and criminal,there are some unreasonable points.The duty of prison hospitals is to ensure the health of prisoners,so that they can enjoy medical rights and manage criminals.At the same time,the prison hospital,as an independent institution within the prison,should abide by the internal management system and the prison law,but also comply with the medical regulations.The medical system of the prison hospital mainly includes three aspects,the management of the offenders,the guarantee of medical funds and the medical institutions and personnel.The construction of a unique medical system with its applicable laws and regulations,which is consistent with prison characteristics,has become extremely urgent.Prison management is facing enormous challenges in the management of disease offenders.The human rights of the prisoners have been paid much attention to.Although the level of social medical treatment continues to improve,but because of the identity of the prisoners and the special prison environment,many medical regulations can not be effectively implemented.Some of the laws and regulations are obviously inconsistent with the status of prison management,and there is a conflict problem.The right to guarantee the medical security of the prisoners is to reflect the respect for human rights,but only to protect the medical rights of the prisoners,and the essence of the execution of the penalty,which is contrary to the function of the prison itself.In the current prison medical system there are "four" contradictions: first,higher medical expenditure in prison,the contradiction of low financial input;second,the low level of the average medical security of the prisoners,the contradiction of excessive medical treatment of some personnel;third,higher prison law enforcement and unfairness of law enforcement;fourth,social average The medical insurance standard is lower than the medical insurance level of prisoners.All these problems and contradictions are due to the imperfection of the current prison medical system.The most important reason is that the prisons medical insurance public fee system should be actively perfected so that the above contradictions can be solved.Only by building a clear and operational system,can we resolve the contradictions and eliminate the risks.This paper,based on the status of X province and the case of medical system reform in A prison in X Province,combines the literature and the basic theory of public management,and relies on the practice to explore and summarize the contradictions,problems and causes in the practice.In addition,in view of the basic functions of the reform of the prison in China,the "security concept" and the prison development plan,combined with the more mature practice of the reform of medical corrections in various provinces and cities,some suggestions and measures are put forward to fit the reform of the prison medical system in X Province,to solve the "four major" contradictions,and to balance a reasonable and reasonable guarantee.The relationship between the medical rights of prisoners and the execution of penalty will enable the prison to play its role better and lay the foundation for the better development of its prison medical system.
