The right to health is one of the fundamental human rights. However, what happened in food areas one more time in China has posed a threat on the right to human health and life. People can not be ensured about the right to getting safe food. For a time, people get worried about everything as regards food and show increasing concern on safety of food. When it comes to the accident of safe food, people tend to focus on the absence of administration at first, or on the failure to administrative system, as if the government is to blame. In fact, people centering on the absence of administration, neglecting the operator of food business, it is who caused the awful results directly. Accidents of food safety essentially result from food businessmen failing to perform legally safe duty. If we regard food safety as a work of system, at the most, administration could be viewed as’an engineer’, a’drawer’. The food businessman and manufactures, otherwise, could be seen as construction workers. Every part of the system serves the great work. If given the proper the work drawing, whether the work is being completed satisfactorily depends on the workers’efforts to ensure the safety. My paper here aims at the duty of assurance for food safety for the entire food industry, and I illustrate my views from four respects.In the first section, I derive the right to food safety of consumers from their rights and benefits. I continue to analyze the right to food safety of consumers, thus draw a conclusion that food industry should assume most of responsibilities, rather than we ascribe all problems to administration.In the second section, I specify the reality and reason for the food industry to perform duty of food safety.In the third section, the system of food safety of developed states is introduced. I aim to learn from their advanced experience and this will help to perfect our system of food safety. In the forth section, I give suggestions to improve our measures for management, to assure the satisfactory completion of ’the great work’.
