With the development of the Internet and other information technologies,people's attention to judicial trials has been increasing,triggering the public's thinking on judicial trials and their social effects.The Peng Yu case and the Yu Huan case have produced different social effects,which are of inspiration to study the causes of social effects in judicial trials and how to achieve good social effects.Before the study of these issues,it is necessary to define the connotation of the judicial social effect.The social effects of judicial trials refer to the effects of judicial trials on the society.On the one hand,they are recognized by the parties and the rest of the public.On the other hand,they are the role of judicial trials in promoting society and the realization of social values.There are many reasons for the social effects of judicial trials,mainly from the judiciary and society.Among them,the judicial reasons include: some judges lack of judicial capacity,mechanical justice;judicial inefficiency,increased social costs;fraudulent and false cases weakened the credibility of the judiciary;judicial disclosure is not timely,the judiciary can not respond to society in a timely manner.The social causes include: media coverage of the case is not standardized;some lawyers are mercenary and misbehavior;citizens' legal literacy is not high,and public thinking and legal thinking are very different.Correspondingly,to achieve good social effects,it is necessary to improve the judicial capacity of judges;improve judicial efficiency;improve the mechanisms for the prevention,correction,and accountability of false and erroneous cases;promptly open the judiciary and actively respond to social concerns;regulate the behavior of the media and lawyers;Their social responsibility;strengthening the education of the whole people and the legal system,cultivating citizens' legal literacy and professional thinking.
