Civil Law Protection Of Heroic Martyrs' Personality Interests

The heroic martyrs played a positive role in promoting the development of social history,made important contributions and even paid the cost of life.It's the human common emotions and complex to revere martyrs.However,the violation of martyrs has occurred in our country in recent years,the development of media technology also makes it easily happen and expands adverse effects.The violation behavior not only seriously affected the martyrs' personality,but also had great damage to the values and public interests of the society.Based on this social reality and the request of martyrs' personality protection,it's studied based on the provisions of the civil legislation in China.For content,starting with the typical cases of the violation of martyrs' personality,raising questions based on combining the facts and main disputes of both sides,so as to paving for later analysis.It's analyzed the intension and scope,the protection range of the personality,the protection subject and the duration and the responsibility for the infringement of the heroic martyrs combining the provisions of the 185 th article of the General Principles of Civil Law on the protection of heroic martyrs.By analyzing and pointing out the insufficiencies in that provision,this paper puts forward specific and refined suggestions to improve our civil legislation and martyrs' personality protection,so as to show the social demand and spirit of respecting heroic martyrs in this era.
