Research On Several Issues Of The Crime Of Accepting Bribes

Bribery crime is established in the international context and the domestic reality,which is necessary to study.This paper is full of in-depth research and discussion about the crime basing on the theory of criminal law,judicial practice.Clarifying the problems of the crime is in order to help the legislative and judicial practice.First,the paper elaborates the legislative background,process and significance of the crime.Then take a brief overview about the crime concept,character and crime constitutes.On this basis,to get a comprehensive,in-depth understanding of the crime,the second part gives a comprehensive analysis to the identification of it.The main contents include the problem of the difference from bribery by influence to mediating bribery,to introducing bribery,to racketeer and so on.The third part is the emphasis of this paper,which presents and analyzes the specific issues of the crime in the legislative and judicial process.They include: the definition of "near relatives" and "close persons" of the crime;the problem of the unit crime;the problem of accomplice of the crime;the definition of seeking a benefits for the trustees;the definition of the influence;the definition of filing standards and the details for adjudication.The fourth part of the article gives my suggestions for the problems of the crime.
