Research On The Protection Of Farmland Property Right In China Since The Reform And Opening Up

China is a large agricultural country with nearly 700 million agricultural population.Agriculture is the foundation of the national economy and the land system is the basic economic system in the countryside.The system of farmland property rights,the core content,affects the agricultural management and farmers' interests by specifying the behavior of people in the use of agricultural land to boundary select and the behavior expectation and guides the decisions of people in the use of agricultural land.The function of farmland property right system depends on the continuity and stability of farmland property rights which lies on the protection of the farmland property rights.Therefore,researching in China's current protection of farmland property rights has important theoretical and realistic significance.From a theoretical point of view,the system of farmland property right protection is an important part of the farmland property right system.In the different stages of human social development,the content of farmland property rights system is different by the constraint of social system,culture,customs,technology and other factors.So that functions of the scope and extent of this system are also different.Study on farmland protection system by exploring the ways of the protection of farmland property rights under different system conditions is conducive to enrich the theoretical content of the land property right system and can promote the theoretical development of the rural land system.From a practical point of view,the agricultural land system has played an important role in the development of rural economy since 1978.But the farmland property right has not been effectively protected because of the influence of various factors which has also damaged the interests of farmers and affected the long-term sustainable development of the rural economy.Analyzing of the problems existing in the protection of agricultural land property rights in China and exploring the effective ways to protect agricultural land property rights have an important practical significance on mobilizing the enthusiasm of farmers,playing the incentive effect of agricultural land property rights,and promoting the stability and prosperity of the rural economy.For the above-mentioned reasons,this paper,focused on the protection of agricultural land property rights with basic on theoretical analysis and evidence by analysis of survey data,studies on the problems existing in the protection of farmland property right at the present stage of our country and puts forward the policy suggestions on strengthening the protection of rural,land property right.The first part mainly introduces the background and significance of.the topic and analyzes the current situation of domestic and foreign research.Then,builds the basic framework and main content of this paper,notes the probable innovation points and existing problems.The second part explains the basic concepts of agricultural land,agricultural land property rights and land property rights protection.Then,it expounds the system of the state theory,theory of constitution theory,collective action theory and game theory by focusing on property rights theory.These above laid the theoretical foundation of this article.The third part analyzes the status of the protection of agricultural land property rights in China since the reform and opening.Firstly,it introduces the process of the reform of agricultural land property right and the achievements in the field of agricultural land property right protection.Secondly,it makes an analysis of the main problems of the current rural land property rights protection in the process of farmers' land rights problems from the macro level such as encroachments on land rights and interests of farmers,serious loss of arable land,rural ecological deterioration,Inefficient scale management and the lack of social security function of rural land.Lastly,It analyzes the causes of these problems from the angle of system design,government execution and farmer consciousness.The fourth part selects Dafeng area,Yancheng City,Jiangsu Province as an exmple.It analyzes the current situation and existing problems of the agricultural land property right by the survey data.This example further verifies the problems in the process of agricultural land property rights protection,and provides empirical basis for the theoretical analysis.The fifth part,base on discussing the importance and significance of farmland property right protection,explores the policy measures for the reform of agricultural land property rights,and puts forward the policy recommendations to further strengthen the protection of agricultural land property rights.
