| For the first time in the report of the Seventeenth Party Congress put forward "create conditions to allow more farmers to obtain property income,then the policy continues this idea,actively promote the farmers housing property mortgage,guarantee,transfer,to give farmers more property rights.Loans to farmers housing property mortgage development,to further deepen the reform of rural collective property rights system,solving the problem of rural financing difficulties,financing expensive,effectively revitalize the existing resources in rural areas,promote agricultural development,rural prosperity and the increase of farmers’ income is very important.At present,our country has begun to pilot the mortgage of housing property right in some areas with relatively early start and mature natural conditions.Among them,Heilongjiang,Zhejiang,Qinghai and Guangxi provinces,cities and counties(regions)and other places of pilot practice has a certain representation.In view of this,this paper carefully,learn the related research results,especially in the modern property right theory,credit guarantee theory,combing the current situation of farmers housing property mortgage loan business,the analysis and study of Heilongjiang city of Daqing Province,Zhejiang Province,Lishui City,Huangyuan County,Qinghai Province,Guangxi Province and more,master and the actual situation of the pilot,and combined with the method of case analysis,comparison of the pilot area pattern.The common points are discovered: the homestead system reform is the basis;the related system construction is guaranteed;additional risk prevention measures;commonly used to go with the house mode;and the rural housing mortgage is still facing legal obstacles;assessment of the value of housing mortgage;rural property transfer restrictions facing rural property is indeed the right certification;work is lagging behind;the lack of a sound risk safeguard mechanism" and other common problems.Different points are: the value evaluation mechanism is different;whether the establishment of property rights transfer trading platform;risk sharing mechanism is different;collateral disposal links are different;loan patterns are different.At the same time,based on looking for similarities and differences,to find the problem,sum up experience and lessons,the analysis of the causes,and puts forward some countermeasures and suggestions of farmers housing property mortgage loans,improve relevant laws and regulations as soon as possible;to accelerate the sound value of right to work;mechanism;establish the unified process of issuing loans;to establish risk sharing mechanism;strengthen the real loss the security;to strengthen the construction of rural credit system. |
