Research On Rural Land Confirmation Dispute

Rural problems have always been an important issue in Chinese society.The land issue is the fundamental problem of rural problem.Land is the basic production and living data of peasants.It is the last guarantee for survival.Entering the new period,to solve the rural land problem fundamentally,the central government has promoted the work of land confirmation four times.ln particular,the latest round of land confirmation in 2013 has a broader coverage.The reconfirmation of land property rights is a guarantee for farmers' land rights.The purpose is to confirm,register and certify,make full use of land resources in rural areas,to promote the land circulation,the agricultural land intensive management.The land conflict is the disharmony caused by the friction,dispute and contradiction in land possession or land interest between different stakeholders.Land dispute is a kind of mitigation form of land conflict,is the conflict of interests between different interest groups.In the view of social conflict,land disputes can also be understood as another way to promote harmony through conflict.The fundamentality of land determines the universality of land disputes.ln particular,the new round of land confirmation work has stimulated the outbreak of land disputes.In addition,land disputes is the game of interest relationship between the different subjects intricately.The land disputes appropriately typed division is the basis of accurate grasping the land disputes.Selected in this paper,based on this,huaiyuan county,anhui province as the research region,doing the research analysis.And according to the different land disputes subject object,land disputes are divided into individual and individual,individual and collective disputes and collective disputes and collective disputes three categories,and with detail case analysis.On the basis of the analysis of land disputes,this paper deeply analyzes the underlying causes of land disputes on the macro level.It is pointed out that the new round of land confirmation work is the direct cause,and the deep economic,political,social and historical reasons behind it:the land value income layer rises layer by layer,the defects of the policy system are prominent,the decline and disconnection of rural society,the management of land reform has accumulated.Correspondingly,in view of the deep cause of multi-party land disputes analyzed in this paper,this paper focuses on the dispute mediation between the mediation mechanism and the source prevention and control of land disputes.The implementation of mediation mechanism is inseparable from the role of rural pluralism:rural social elites,village cadres and rural social organizations will be the main force of mediation.However,the source control of disputes is relatively broad,so we should improve the relevant land system,establish and perfect the rural social security system,and strengthen social management.It is worth noting that the dispute mediation in this paper is only a kind of orientation mediation,expecting to properly resolve land disputes through mediation and source prevention and control.It lacks concrete practical measures.The proper settlement of land disputes is not a day's work.It still needs the attention of the academic circles,and actively explores the path of resolving land disputes with strong operability.
