Since the forty years of reform and opening up,China's economic and social development has made remarkable achievements.But what can not be ignored is that the environmental pollution in China is becoming more and more serious,which seriously affects the production and life of the people.As one of the core management system of fixed pollution source environment of China's sewage permit system is an important legal basis for the sewage enterprises in the production process,pollution control equipment has an important significance for the protection of the environment impact assessment and proposed the implementation of relevant measures.After 30 years of development,China's emission permit system has played a positive role in controlling pollution and protecting the environment.But there are still many problems that can not meet the new situation of the new era.The main cause of the above situation is the incomplete legal system of pollutant discharge license,the unsound procedure guarantee and the weak supervision of the implementation.In the face of Chinese socialism historical orientation into a new era,facing the new situation of the masses of the people for a better life demand,we should reform the environmental management concept,legal system construction permits a scientific and rational system,improve the system mechanism for the implementation of emission permit system.Based on the latest trend of ecological civilization construction and reform in our country,this paper researches the legislation on pollutants discharge licence system.According to the analysis on the historical development and current situation of legislation on pollutants discharge licence system in our country,the author thinks though the pollutants discharge licence system has been practiced in our country for decades of years,the legislation process of pollutants discharge licence system in our country is still slow and exists with the following problems such as low level of standardization,weakening of legal core position of pollutants discharge license system,non-smooth connection between related systems,serious fragmentization of legal standards of pollutants discharge licence system,narrow application scope,imperfect legal guarantee mechanism for public participation,insufficient support of legal supervision,weak supervision of law and so on."There are other hills where stones are good for working jade".The author conducts investigation and analysis on the legislation on pollutants discharge licence systems of developed economic entities such as America,EU and Japan,combined with the actual situation of our country,puts forward the following suggestions on perfecting the legislation on pollutants discharge licence system in our country:prefect the legislation on pollutants discharge licence system and its supporting legal systems,formulate Regulations on Pollutants Discharge Licence as soon as possible;Take pollutants discharge licence system as the core to integrate various environmental management systems;enlarge the applicable scope of pollutants discharge licence,and gradually incorporate the environmental factors such as solid waste and noise into the applicable scope;perfect the legislation on information openness and guarantee public participation;intensify the post-supervision legal responsibility,realize overall management,incorporate environmental protection into assessment scope of government work and promote the implementation of pollutants discharge licence system.
