Research On Comprehensive Law Enforcement Reform Of Ecological Environment Protection From The Perspective Of Public Governance

Comprehensive law enforcement has broken the tradition of almost all government departments have law enforcement tasks.A small number of departments are responsible for centralized law enforcement,which not only satisfies the requirements of “simplification” of law enforcement team personnel,but also reduces the situation in which the departments are only in charge of their own political affairs and their powers conflict with each other,which can effectively improve the efficiency of law enforcement and is in line with the spirit of public governance and the development trend of modern administration.The comprehensive law enforcement reform of ecological environment protection is not only the highlight of the reform of the new public management system,but also a key point of building a government under the rule of law and a service-oriented government.With the implementation of government institutional reforms in 2018,China's comprehensive environmental protection law enforcement reform has achieved remarkable achievements.But various problems have appeared at the same time,which has restricts the further development of comprehensive environmental law enforcement.The public governance theory that emerged in the 1990 s provides a new theoretical perspective for thinking and studying government public management models and the transformation of governance structures.Comprehensive law enforcement reform is a practical response to the theory of public governance under the realistic predicament of departmental administration caused by excessive decentralization.The article attempts to analyze the problems existing in the comprehensive law enforcement reform of ecological environment protection from the perspective of public governance,and proposes countermeasures to improve the comprehensive law enforcement reform of ecological environment protection under the view of public governance,in order to overcome the difficulties in the current environmental law enforcement system reform.The first part introduces the background and development trend of environmental public governance,and highlights the important role of environmental comprehensive law enforcement reform in environmental public governance by clarifying the relationship between environmental public governance and environmental comprehensive law enforcement.And it also discusses the necessity of comprehensive environmental protection reform of ecological environment protection from the shortcomings of the traditional environmental law enforcement system by analyzing the superiority of comprehensive administrative law enforcement.The second part describes the history of comprehensive environmental protection reform of ecological environment protection,it focuses on the main contents of the reform after the comprehensive environmental law enforcement reform enters a new stage,and analyzes the model,leadership system,hierarchical design,subject status and team building of comprehensive environmental law enforcement.The third part is to explore the problems in the view of public governance,analyze the problems with a developmental perspective,and distinguish the unresolved problems and emerging problems in the new stage of reform.Although the comprehensive reform of the ecological environment has broken through many of the shortcomings of the traditional law enforcement system in the new stage of the reform of the administrative law enforcement system,there are still some problems that have not been resolved.Old problems like inefficient traditional enforcement methods,weak legal basis of reform,and low degree of the public participation are still exist.while there are other new issues need to be resolved such as the departmental coordination mechanisms is missing,the county-level environmental protection department has lost its independent administrative subject status,the allocation of integrated law enforcement power is unclear and so on.Finally,the public governance paradigm emphasizes communication and collaboration between different subjects,emphasizes public participation,emphasizes the government's leading role in plural governance,emphasizes the scientific nature of law,and the role of government transform from “ruling” to “cooperation”,“management” to "service".According to the problems existing in the comprehensive law enforcement reform of ecological environment protection,it is suggested that the comprehensive environmental protection law enforcement reform should be carried out in the perspective of public governance,and combined with the content of public governance theory,the corresponding countermeasures are proposed.By promoting departmental coordination,safeguarding administrative power,changing law enforcement methods,enhancing legal protection,and expanding public participation,improve the comprehensive law enforcement reform of ecological environment protection and promote the transformation of traditional bureaucracy to environmental public governance.
